1. Acceptance of Terms

By accessing or using Hilly Arch (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users, including teachers, students, and administrators.

2. Description of Service

Hilly Arch provides a secure, web‑based platform for educational organisations to manage file sharing, secure messaging, and learner communications. The Platform is intended for use by authorised organisations and their members only.

3. Accounts and Access

  • You must provide accurate information when creating an account.
  • You are responsible for keeping your login credentials confidential. Notify us immediately of any unauthorised access.
  • Accounts are personal and may not be shared or transferred to another individual.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use the Platform to:

  • Upload or share illegal, harmful, or offensive content
  • Harass, bully, or discriminate against other users
  • Attempt to gain unauthorised access to other accounts or systems
  • Use automated tools to scrape, copy, or extract Platform content
  • Circumvent security features or disrupt the Platform's availability

We reserve the right to remove content or suspend access that violates these guidelines without notice.

5. Content Ownership

You retain ownership of all content you upload to the Platform. By uploading content, you grant Hilly Arch a limited, non‑exclusive licence to store and display that content solely for the purpose of providing the service to you.

You are responsible for ensuring you have the right to share any content you upload, including materials subject to copyright or other intellectual property rights.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with UK GDPR.

7. Availability and Uptime

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may carry out maintenance, updates, or emergency work that temporarily affects availability. We will endeavour to provide advance notice where possible.

8. Limitation of Liability

To the fullest extent permitted by law, Hilly Arch shall not be liable for any indirect, incidental, or consequential losses arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or disruption to operations.

Our total liability to you shall not exceed the amount paid by your organisation for the Platform in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement with 30 days' written notice. Upon termination, your access to the Platform will be suspended and your data will be deleted in accordance with our retention policy (see Privacy Policy).

We may terminate immediately in cases of serious breach, misuse, or illegal activity.

10. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Platform after updates constitutes acceptance of the revised Terms. We will notify registered organisations of significant changes by email.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
